Management corporation facing contested AGM procedures
A residential condominium management corporation contacted thornwickess after a contested AGM where several resolutions were challenged on procedural grounds. Relations between the council and a group of subsidiary proprietors had deteriorated over levy collection disputes.
We reviewed the by-laws, the AGM minutes, and the correspondence exchanged. An advisory report was produced setting out which resolutions were procedurally sound and which required remedial steps. A revised AGM procedure guide was also provided.
The management corporation was able to convene a supplementary meeting within the engagement period. The contested resolutions were re-passed without further challenge. The advisory report continues to serve as the council's reference document for governance matters.
